Proposed Development
The Township of Wilmot is in receipt of an application for an amendment to the Township Official Plan and an application for changes to the Township Zoning By-law.
59 Bergey Court and 12 Shephard Place together are proposed to be redeveloped with 35 townhomes.
A portion of the proposed development area is presently designated Open Space in the Township Official Plan. The official plan amendment application proposes to change the designation of the lands above the regulatory flood elevation from Open Space to Urban Residential.
The zone change application proposes:
- to rezone the lands above the regulatory flood elevation from Zone 2 and 2f (Residential) to Zone 4a (Residential);
- to amend zoning regulations with respect front and exterior side yard setbacks, driveway widths, and lot areas resulting from future title separation of each of the units; and
- to rezone the lands below the regulatory flood elevation from Zone 2f (Residential) to Zone 11 (Open Space).

In accordance with Sections 34(19) of the Planning Act, an appeal may only be filed by the applicant, the registered owner, Minister of Municipal Affairs and Housing, or a specified person or public body that has interest in the matter.
As of June 6, 2024, Provincial Bill 185 removed third party appeal rights, with limited exception (provided they made submissions to council before the decision is made). Appeals to development approvals can no longer be filed by neighbours, individuals, companies, and community associations.
Landowners will continue to have the right to file appeals of Planning Act decisions that affect land they own.
